These Terms govern your use of the ZEN Performance & Recovery, LLC website and services ("ZEN," "we," "us"). By booking, purchasing, or receiving services, you agree to these Terms and to our Privacy Policy. Services are provided by Nadja Uskokovic, LMT, a licensed massage therapist in the State of North Dakota.
ZEN provides therapeutic massage and bodywork for relaxation and the relief of muscular tension. Massage therapy is not a substitute for medical diagnosis, treatment, or psychiatric care. We do not diagnose illness, prescribe, or perform any service outside the lawful scope of massage therapy in North Dakota. Sessions are strictly professional and non-sexual; any inappropriate conduct ends the session immediately with full payment due.
A $30 deposit secures your appointment and is applied to your session total when you attend — so you never lose it by showing up. Cancel or reschedule with at least 24 hours' notice and your deposit carries over to your rescheduled visit. Cancellations inside 24 hours, or missed appointments (no-shows), forfeit the deposit. If you are unwell, contact us — we would rather reschedule than have you push through.
Gift cards are redeemable for any service and, consistent with federal law (the CARD Act), do not expire for at least five years from the date of purchase — in practice, they never expire with us. Gift cards are non-refundable and may be transferred to another person.
We accept cash and, where offered, card payment processed by our third-party processor (Stripe). We do not store your full card number. Prices are as listed at the time of booking; a refundable deposit or, for mobile visits, a travel fee may apply as described below.
Service area & travel. Mobile appointments are based out of Williston, North Dakota. Availability outside the immediate area is case-by-case and a travel fee may apply; the fee is shown before you confirm.
Client responsibilities. For a mobile session you agree to provide a safe, clean, private, and appropriately sized space, adequate lighting, and a firm surface area for the massage table. A responsible adult must be present or reachable as required by law.
Weather. North Dakota weather can make travel unsafe. We reserve the right to reschedule mobile appointments for weather or road conditions at no penalty to either party; your deposit carries over.
Right to terminate. We reserve the right to decline or immediately end a mobile session and leave if we encounter conditions that are unsafe, unsanitary, intoxicated, or inappropriate. In such cases the full session fee remains due.
Property. Reasonable care is taken during setup and service. Except in the case of our gross negligence, ZEN is not responsible for incidental damage to a client's home or property (for example, oil marks or items disturbed during table setup). A separate signed mobile property waiver applies to in-home visits.
Before your first session you must complete our intake form, including a health-history and contraindications questionnaire, a written informed-consent, and a draping-policy agreement. You are responsible for disclosing medical conditions, medications, allergies, and injuries, and for updating us on any changes. Withholding or misrepresenting health information may put you at risk and releases ZEN from liability for resulting harm.
You voluntarily participate in massage services and assume the ordinary risks associated with them. To the fullest extent permitted by North Dakota law, ZEN's total liability arising from the services is limited to the amount you paid for the session at issue. ZEN is not liable for indirect or consequential damages. Nothing in these Terms limits liability that cannot be limited by law.
Your health information is handled per our Privacy Policy and applicable North Dakota record-keeping rules. Client records are kept confidential and retained as required by law. We do not sell your information.
